Texas couples learn about divorce issues from celeb divorce

With the impending divorce of celebrity stars Ben Affleck and Jennifer Garner on the front page of every tabloid nationwide, divorce once again takes center stage in America. But for many Texas residents, divorce issues can be something of a mystery. While the differences in assets may be vast, Texans could learn something about the divorce process by paying attention to this particular case.

The divorce papers in the Affleck/Garner case were filed precisely 10 years and one day following their legal marriage. This was no accident, according to some experts, who believe that Ms. Garner specifically waited that long to file because the couple's home state considers 10 years a "long-term marriage." This would have implications on any spousal support settlement that might be reached, as a "long-term" marriage denotes a higher settlement value. 

Of course, the possibility that a prenuptial agreement was in effect in their case is also a conceivable reason for such a specific filing date. Ultimately, the rules of divorce are dictated largely by the state, and as such, one is able to strategize to a degree about how to go about getting divorced to reap the most benefits. This is valuable information for both parties in a separation.

Divorce issues are widespread and myriad, as any divorced Texas resident can attest. However, knowing the legislature about divorce in an individual's home state can go a long way toward preparing both parties for the challenges to come. Ideally, foreknowledge of their roles, rights and responsibilities in a divorce situation can lead both parties to an equitable settlement quickly and effectively.
